TERMS OF SALE

 1. General

1.1. These are the Terms of Sale of CICHART GmbH, Königstraße 27, 70173 Stuttgart, Germany (hereinafter "we", "us", "our").

1.2. These Terms of Sale entered into force on 22 March 2026.

1.3. These Terms of Sale apply to the sale of products and services on this website. Please read them before placing an order. By placing an order on this website, you agree to be bound by these Terms of Sale. Before placing an order, you will be asked to confirm your acceptance by ticking the relevant box. If you do not confirm acceptance, you may not place orders on this website.

1.4. By placing an order on this website, you confirm that you are of legal age and legally capable of entering into a consumer contract.

2.1. Your order on this website constitutes an offer to purchase under these Terms of Sale.

2.2. After placing your order, you will receive an email confirming that we have received it. Please note that this does not mean your order has been accepted. Orders are subject to acceptance by us and the availability of the ordered products and services.

2.3. Product and service descriptions are correct at the time of publication but may change without notice. We accept no liability for errors in photography or typography.

2.4. Information you provide in connection with your order — such as messages for gift cards, personalisation texts, or photographs of your finger — may be refused without giving reasons. In such cases, we reserve the right to cancel your contract and issue a refund or cancel your order. We accept no responsibility for the accuracy or suitability of such information.

2.5. We reserve the right to carry out identity and credit checks to prevent fraud.

2.6. We confirm acceptance of your purchase offer by sending an order confirmation (invoice) by email, which constitutes a binding contract between you and us.

2.7. The contract relates only to those products and services whose dispatch we have confirmed in the order confirmation. We are not obliged to supply any other products or services that may have formed part of your order until their dispatch is confirmed in a separate order confirmation.

3.1. Prices on this website are in euros and include local VAT. Delivery is free of charge for all orders.

3.2. We may change prices on this website at any time. This does not apply to prices already confirmed in an order confirmation.

3.3. You may pay using the payment options available on this website at the time of your purchase. These may include:

3.3.1. Credit cards such as Visa, American Express, Mastercard, or Union Pay.

3.3.2. Payment by invoice as offered by Klarna.

3.3.3. Direct bank transfer as offered by Klarna.

3.3.4. Instalment payment as offered by Klarna.

3.3.5. PayPal

3.4. If you pay by credit card, you are subject to validation and authorisation by the card issuer. We may share your personal data with such third parties as are necessary to carry out these checks. If the card issuer refuses to authorise payment, the order will not be accepted. We will only charge your credit card when your order is dispatched. We may withhold delivery until full payment is received and may terminate the contract with immediate written notice if you fail to pay on time without good cause.

3.5. We may offer alternative payment options in cooperation with third-party providers. By choosing such options, you agree to be bound by the terms of those providers and acknowledge that they will process your personal data for payment purposes.

3.6. Our website contains a large number of products and services, and it is possible that some may be incorrectly priced. We will verify prices as part of our dispatch process. If the correct price is lower than stated, we will charge the lower amount. If it is higher, we will contact you for instructions or decline the order and notify you accordingly.

3.7. We are not obliged to supply a product or service at an obviously incorrect (lower) price where the pricing error is apparent and should reasonably have been recognised as such.

4.1. Since every CICHART® ring watch is individually manufactured as a unique piece only after receipt of your ring size, delivery typically takes 4 to 8 weeks from confirmation of your measurements. Delivery is free of charge. CICHART® keeps you informed at every stage of production.

4.2. If we are unable to deliver within the stated delivery period, we will contact you to propose a new date. If we are unable to deliver within 30 days of the expiry of the confirmed delivery period and you reject the delayed delivery, you may cancel your order and receive a full refund.

4.3. We deliver to the delivery address you provide. Delivery to hotels or freight forwarding addresses is not possible.

5.1. Ownership of the products passes to you once we have received full payment of all amounts due or the products have been delivered to you. We may reclaim any delivered products at any time prior to transfer of ownership if you breach these Terms of Sale.

5.2. Risk in the products passes to you upon delivery. Risk for the purposes of this clause means responsibility for damage arising from or in connection with the use, handling, or storage of the products.

6.1. Our liability is excluded and limited to the extent permitted by law.

7.1. Contracts concluded on this website between you and us are governed by the laws of the Federal Republic of Germany, without application of its conflict of law rules. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

7.2. To the extent permitted by law, disputes shall be subject to the exclusive jurisdiction of the ordinary courts in Stuttgart, Germany, without prejudice to the right of appeal. Notwithstanding the foregoing, either party may seek interim injunctions and restraining orders from any competent authority worldwide.

7.3. Disputes may also be submitted for online resolution to the European Commission's Online Dispute Resolution platform.

8.1. You may not assign any rights under your contract with us to third parties without our prior written consent.

8.2. The invalidity of any provision of these Terms of Sale does not affect the validity of the contract between you and us.

8.3. By using this website, you consent to electronic communication with us.

9.1. Important notice regarding individual manufacture: Since every CICHART® ring watch is manufactured as a unique piece only after receipt of your personal ring size, it falls under the statutory exemption for goods produced to customer specifications. The right of withdrawal is excluded for all individually manufactured CICHART® ring watches and for all Limited Editions. This exclusion is communicated to you explicitly before conclusion of the purchase agreement and requires your express confirmation.

9.2. For products not subject to the exclusion under clause 9.1, you have the right to withdraw from this contract within fourteen days without giving reasons.

9.3. The withdrawal period is fourteen days from the day on which you or a third party designated by you, other than the carrier, takes possession of the goods.

9.4. To exercise your right of withdrawal, you must notify us — CICHART GmbH, Königstraße 27, 70173 Stuttgart, Germany, Tel: +49 (0)711-49050285, Email: contact@cichart.com — by means of a clear declaration (e.g. by post or email) of your decision to withdraw from this contract. It is sufficient to send the notice before the expiry of the withdrawal period.

9.5. Only new, unworn products including the warranty certificate (with Limited Edition number and serial number) and original packaging will be accepted for return. Damaged products will not be accepted.

9.6. Consequences of withdrawal: If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs, without undue delay and no later than fourteen days from the day we receive notice of your withdrawal. We will use the same payment method you used for the original transaction; you will not incur any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back or until you provide proof of return, whichever is earlier.

9.7. You must return the goods to us without undue delay and no later than fourteen days from the day you notify us of your withdrawal: CICHART GmbH, Königstraße 27, 70173 Stuttgart, Germany. The deadline is met if you send the goods before the expiry of the fourteen-day period. Further information on returns can be found in our Delivery and Return Conditions at cichart.com.

9.8. We bear the cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.

10.1. We do not participate in dispute resolution proceedings before a consumer arbitration board.
