Terms of Sale
1. General
1.1. These are the Terms of Sale of CICHART GmbH, Königstraße 27, 70173 Stuttgart, Germany ("we", "us", "our").
1.2. These Terms of Sale apply in the version dated 9 July 2026.
1.3. These Terms of Sale apply to the sale of products and services on this website. Please read them before ordering. By placing an order on this website, you agree to be bound by these Terms of Sale. Before ordering, you will be asked to confirm your acceptance by ticking the corresponding box. If you do not confirm acceptance, you may not place orders on this website.
1.4. By ordering on this website, you confirm that you are of legal age and have the legal capacity to conclude a consumer contract.
2. Ordering Process
2.1. Your order on this website constitutes an offer to purchase under these Terms of Sale.
2.2. After ordering, you will receive an email confirming that we have received your order. Please note that this does not mean your order has been accepted. Orders require acceptance by us and the availability of the ordered products and services.
2.3. Product and service descriptions are accurate at the time of publication but may change without notice. Obvious errors in photography or typography do not give rise to any claim.
2.4. Information you provide in connection with your order — such as personalization texts — may be rejected without stating reasons. In that case, we may withdraw from the contract and refund all payments made in full.
2.5. We reserve the right to carry out identity and credit checks to prevent fraud.
2.6. We confirm acceptance of your purchase offer by sending an order confirmation by email, which constitutes a binding contract between you and us.
2.7. The contract relates only to those products and services confirmed by us in the order confirmation.
3. Price and Payment
3.1. Prices on this website are in euros and include statutory VAT. Delivery within Germany and the European Union is free of charge.
3.2. We may change prices on this website at any time. This does not apply to prices already confirmed in an order confirmation.
3.3. You may pay via the payment options available on this website at the time of your purchase. These may include: credit cards (Visa, American Express, Mastercard, Union Pay), invoice, direct bank transfer, and installments (each as offered by Klarna), as well as PayPal.
3.4. Pre-orders: For a pre-order, a deposit of 30% of the total price is due at checkout; your payment method is stored. The remaining balance is charged automatically to your stored payment method before shipment. You will be notified by email in advance of the charge. By placing the order, you expressly consent to this payment procedure.
3.5. When paying by credit card, you are subject to validation checks and authorization by the card issuer. We may pass on your personal data to such third parties to the extent necessary for these checks. If the card issuer does not authorize payment, the order will not be accepted. If collection of the remaining balance fails, we will contact you; we may withhold delivery until full payment has been received.
3.6. We may offer alternative payment options in cooperation with third-party providers. If you choose such options, you agree to be bound by the terms of those providers and acknowledge that they process your personal data for payment purposes.
3.7. Should a product be priced incorrectly despite all care: if the correct price is lower than stated, we will charge the lower amount. If it is higher, we will contact you or reject your order and inform you accordingly. We are not obliged to supply a product at an obviously incorrect (lower) price if the pricing error was recognizable to you.
4. Delivery
4.1. The CICHART® 104 is offered in standard ring sizes. For pre-orders, the expected delivery date is stated on the product page and in the order confirmation. Delivery is free of charge. We will keep you transparently informed of progress.
4.2. If we cannot deliver within the stated delivery time, we will contact you and propose a new date. If we cannot deliver within 30 days after expiry of the confirmed delivery time and you decline late delivery, you may cancel your order against a full refund of all payments made.
4.3. You may cancel your pre-order free of charge at any time before shipment; your deposit will be refunded in full.
4.4. We deliver to the delivery address you provide. Delivery to hotels or freight-forwarding addresses is not possible.
5. Custom Orders
5.1. A custom order exists exclusively when you order a ring size that is not among the standard sizes offered. Custom orders are made individually to your measurement.
5.2. For custom orders pursuant to Section 5.1, the right of withdrawal is excluded pursuant to Section 312g (2) no. 1 of the German Civil Code (BGB) (goods made to customer specification). This exclusion will be expressly communicated to you before conclusion of the contract and requires your express confirmation during the ordering process.
6. Size Exchange
6.1. If the chosen standard size does not fit, we will exchange your CICHART 104 for another available standard size. Condition: the ring is unworn and undamaged and is returned in its original packaging. The size exchange is a voluntary service and does not affect your statutory right of withdrawal. Details are governed by our Shipping & Delivery Terms.
7. Transfer of Title and Risk
7.1. Title to the products passes to you once we have received full payment of all amounts due. Risk passes to you upon delivery.
8. Liability
8.1. We are liable without limitation for intent and gross negligence, and for damage arising from injury to life, body, or health.
8.2. In cases of slight negligence, we are liable only for the breach of an essential contractual obligation (cardinal obligation) whose fulfillment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely. In such cases, liability is limited to the foreseeable damage typical for the contract.
8.3. Liability under the German Product Liability Act remains unaffected.
9. Law and Jurisdiction
9.1. Contracts concluded between you and us on this website are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer habitually resident abroad, mandatory consumer-protection provisions of your state of residence remain unaffected.
9.2. To the extent legally permissible, the place of jurisdiction is Stuttgart, Germany.
10. Withdrawal Notice
10.1. Right of withdrawal: You have the right to withdraw from this contract within fourteen days without giving reasons. The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods.
10.2. Exception: For custom orders pursuant to Section 5 (ring sizes outside the four standard sizes), the right of withdrawal is excluded pursuant to Section 312g (2) no. 1 BGB.
10.3. To exercise your right of withdrawal, you must inform us — CICHART GmbH, Königstraße 27, 70173 Stuttgart, phone: +49 (0)711-49050285, email: contact@cichart.com — of your decision to withdraw from this contract by means of a clear declaration (e.g., by post or email). You may use the statutory model withdrawal form, which is, however, not mandatory.
10.4. You may also declare your withdrawal via the online withdrawal function (“withdraw from contract”) on our website. If you use this option, you will receive prompt confirmation of receipt of your withdrawal (e.g., by email).
10.5. To meet the withdrawal deadline, it is sufficient that you send the notification of exercising the right of withdrawal before the withdrawal period expires.
10.6. Consequences of withdrawal: If you withdraw from this contract, we shall refund all payments received from you, including delivery costs, without undue delay and at the latest within fourteen days from the day on which we received notification of your withdrawal. For this refund, we will use the same means of payment you used for the original transaction; in no case will you be charged fees for this refund. We may refuse the refund until we have received the goods back or until you have provided proof of return shipment, whichever is earlier.
10.7. You must return the goods to us without undue delay and at the latest within fourteen days from the day on which you notify us of the withdrawal: CICHART GmbH, Königstraße 27, 70173 Stuttgart, Germany. The deadline is met if you dispatch the goods before the fourteen-day period expires. We bear the costs of the return shipment.
10.8. You are liable for any diminished value of the goods only if this results from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
11. Miscellaneous
11.1. You may not assign rights under your contract with us to third parties without our prior written consent.
11.2. The invalidity of any provision of these Terms of Sale does not affect the validity of the remaining provisions.
11.3. By using this website, you consent to electronic communication with us.
11.4. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
